this is consistent with the orders of the CIC on various cases like the DIAL and BIAL and Mumbai Ports etc
pg 154 section / chapter on Right to Information and Public private partnership No 119
Right to Information
Any person may, upon application under the provisions of the Right to Information Act, 2005, require the concessionaire of a PPP project to provide any information that is relevant to the interests of the Government, any public entity or the users of the PPP project, and for the purposes of providing such information, the concessionaire shall be deemed to be a public authority under clause (h) of section 2 of that Act.
so does the new draft PPP policy 2011 (http://pppinindia.com/draftpolicy.php)introduced a week (28/9/2011) later choose to ignore this proposal on RTIs in the draft procurement bill 2011?
the new draft PPP policy 2011is prepared under the aegis of the ongoing mainstreaming PPP in India project with TAgrantsand loans in which most central ministries are pushing and all states have a nodal agency as well.mostly in the Infra Development Department/ Secretariat headed by a consultant.
