SOCIAL JURIST, A Civil Rights Group   To   Hon'ble the Education Minister, Government of NCT of Delhi, Secretariat, I P Estate, New Delhi-110002                                                                             30.12.2010  Subject: Violation of Age Rule - Complaint against Shri Ram School, APEEJAY Schools and Delhi Public Schools  Sir,  It is brought to your notice that the advertisement of Shri Ram School, Vasant Vihar, New Delhi- 57, APEEJAY School, Sheikh Sarai and Pitampura and Delhi Public School East of Kalash and Vasant Vihar have appeared in today's Times of India dated 30.12.2010 whereby they have announced Admission to Pre School Session 2011-2012 with the eligibility age 3+ as on 31.03.2011. The children admitted in pre-school in these schools would be automatically promoted to pre-primary and then to class 1st. In short, these schools are admitting children at the age of 3+ instead 4+ and are running two years classes below class 1st. It is all in violation of law.  I would like to invite your attention to your affidavit dated 05.09.2007 filed in PIL ( WP (c) No. 12490 of 2006) which formed the part of the judgment dated 26.09.2007 of the Hon'ble Delhi High Court in terms of which you were obliged to  enforce 4+ age as entry age from the academic session 2008-2009 in all the schools of Delhi. However, the same has not been implemented which led to filing of the contempt petition in the Hon'ble Delhi High Court which is now fixed for hearing for 11.01.2011.  That on the last date of hearing on http://www.facebook.com/l/d2e8cybujEXBzTRlvoSLi4-c7vQ;23.12.2010, Ms. Zubeda Begam Advocate appearing for Delhi Government submitted to the Hon'ble Court that if any school was found violating the age rule, why complaint was not made to the department.  It is submitted that irrespective of any complaint, it is the duty of Govt. to ensure effective implementation of the law. In any case, formal complaint is being made hereby against the afore-mentioned schools that are violating the age rule of  4+ for entry of a child in a formal school system.  It is, therefore, requested that immediate action may be taken against the afore-mentioned erring schools and also against other schools found violating the age rule and the Government must ensure that no school grants admission to any child below 4 years age in its formal school.
